WUCIOA for All Legal Challenges and Meeting Minutes

Under RCW 64.90.445, WUCIOA introduces a 90-day window for legal challenges to Board actions. Specifically:
- A Board action is considered valid even if it does not comply with procedural requirements, unless a court sets it aside, and
- Any legal challenge must be filed within 90 days after the Board approves the meeting minutes where the action occurred, or after the record of the action is distributed to unit owners, whichever is later.
This provision limits prolonged uncertainty and encourages Boards to finalize and distribute meeting records promptly.

- Use Standardized Templates: Adopt consistent formatting and language for meeting minutes to ensure clarity and completeness,
- Distribute Minutes Promptly: Share approved minutes with Homeowners as soon as possible. Use email, portals, or printed copies depending on your community’s communication preferences,
- Educate Board Members: Ensure all Board Members understand the legal implications of delayed minute approval and distribution, and
- Consult Legal Counsel: Review your current practices with your attorney to confirm compliance and identify areas for improvement.
